By Frank Goldstein, Managing Partner At the upcoming FIFEC conference in Orlando, attendees will be asked to consider a dichotomy: They’re involved in a major fraud case. Millions of dollars are potentially at stake. Would they ever consider losing such a case? That’s exactly what Assistant State Attorney Michael Lennon of the Florida State Attorney’s Office, Farmers Insurance Manager John C. Thompson, and I will ask them to do on June 10 at the 23rd Annual FIFEC Conference. We’ll even hand them a game plan for losing their fraud cases. I can imagine many of you wondering – why? There’s a reason behind this “madness.” By focusing on losing, we’ll teach attendees how NOT to lose. They’ll walk away with all the tools needed to successfully build a parallel civil and criminal fraud case. Here’s the point: just as there are specific steps that are necessary in order to win a case, there are another set of steps that, if taken, almost assure you’ll lose. The team and I will share guaranteed ways to lose a fraud case. As part of our “losing” presentation, we’ll explore how improved cooperation between law enforcement and insurance companies makes it easier to gather the necessary evidence to “build” successful cases that result in both civil recovery and criminal prosecution. Discussion also will focus on how parallel criminal cases against individuals could result 5th Amendment privileges being invoked…and how that might be advantageous or not in civil suits.
