Auto Insurance Defense
Auto insurance is a more than $220 billion industry that’s complicated and often misunderstood. Goldstein Law Group (GLG) ensures that fair and equitable claim procedures are in place, investigates claims to ensure they are reasonable, and helps prevent, or defend against fraudulent insurance claims.
GLG’s legal experience includes, but is not limited to:
PIP (Personal Injury Protection), or “No Fault,” insurance provisions are complex, enabling individuals and medical clinics to bill for unreasonable, unrelated, unlawful and nonmedically necessary services. Often called “fraud-plagued” insurance, we know the forms PIP deception and ??? fraud take, how to recognize them, and how to combat unscrupulous practices.
Staged Accidents. No one wants to be in an automobile accident, unless they’re trying to collect fraudulent injury claims. We know how staged accident scams operate and put that knowledge to work for clients, preventing false claims from being filed, and suing to recover lost payments when they do occur.
Organized Crime Rings proliferate within “staged accident” schemes. They typically are orchestrated by leaders who draft comprehensive plans for each accident. The rings can be difficult to prosecute, but our teams work hand-in-hand with law enforcement to investigate fraudulent activities, then use out-of-the-box techniques to help shut down these scams.
Straw Owned clinics have popped up everywhere since the enactment of the Health Care Clinic Act. Unscrupulous individuals have used healthcare practicioners’ medical licenses to conceal their true ownership. This has allowed them to submit PIP/no fault claims on behalf of unlawfully operating clinics. Our attorneys have investigated and litigated hundreds of straw ownership cases on behalf of insurance clients.
Fraud Prevention Tactics. We believe the best way to fight fraud is to prevent it from happening in the first place. GLG attorneys support and participate in awareness campaigns, conduct beneficial fraud seminars for insurance companies, adjusters and others, and work with carriers to put into place strong, anti-fraud policies and procedures.
Civil Recovery. Fraud is an unfortunate reality. When defrauded, companies may file civil recovery suits to rectify the fraud, but it’s not always simple. GLG carefully analyzes clients’ goals and resources, provide counsel on the best type of suit, and thoroughly studies opposition strengths before moving forward on a client’s behalf.
Usual, Customary and Reasonable rates are what third-party payers, including insurance carriers, use to determine medical reimbursement. Our team weeds through the discrepancies in these cases and prepares comprehensive, strategic defense strategies for clients inorder to determine whether the medical clinic’s charges are reasonable.
